The judiciary and the executive on belligerence

Apparently the PPP, the ruling party, has been becoming vulnerable to towards the abyss. Its perception that it is encircled with political alliances will not work anymore. At the same time, its desire to become political martyr is getting true.

In conclusion, the court is going to announce the verdicts against the cases pending before the Supreme Court. The government, in the major cases, has defied the court’s rulings.

The judicial commission, appointed by the apex court with Balochistan High Court (BHC) Chief Justice in the chair to investigate the infamous memogate scam, will conclude its findings by the end of January.

The appearance of Mansoor Ijaz before the judicial commission will largely help the matter towards its conclusion. Although he has announced to come Pakistan on January 16, it is vague he will come or not.

President Asif Ali Zardari, in his recent interaction with the media, has clarified that he would only accept the verdict of Parliamentary National Security Committee (PCNS) in the case.

On the other hand, the bench of the Supreme Court formed to implement of the courts orders on NRO (National Reconciliation Ordinance), had given the government a few days to dispatch a letter to the Swiss authorities to open the cases, by January 10.

It also issued a warning saying that the apex court would take severe action if the verdict is unenforced.

Conversely, the PPP-led government is of the opinion that the president enjoyed the immunity, claiming that it has not required any interpretation by the apex court. However, the apex court is not on the same page.

The SC observed that the matter of immunity will be judged by the court, as Constitution does not give any explanation in this regard. In case of the continuing confrontation, the system can have unfavorable impact.

It does not seem that the government will change its policy about writing a letter to Swiss authorities in the final moment.  It is also unclear that will the apex court not lose patience and wait for the government functionaries to implement over the case.

Later or sooner, the SC might think evoking Article 190 of the Constitution, seeking the support of military forces in implementation of verdicts.

One can hopes that the two state organs, the executive and judiciary, will work together to resolve the disputed issues.
