NRO case: Supreme Court declares Prime Minister as violator

The Supreme Court of Pakistan once again pushed the ball towards executive, issuing warnings to Prime Minister Syed Yousaf Raza Gilani of ineligibility for defying imposition of NRO (National Reconciliation Ordinance) orders.

A five-member bench of the apex court with Justice Asif Saeed Khosa in the chair decided to refer six options relating to the NRO implementation case to the Chief Justice to form a larger bench for hearing of these choices.

“The court has the option to record findings and hand down a declaration, which would have an effect of a permanent nature when it comes to the prime minister’s qualification to be chosen as a member of the Parliament,” the order stated.

Justice Khosa while giving remarks in the hearing observed that the Prime Minister did not appear to be a sapient person was obvious from his insolence of the apex court’s verdicts over the NRO. In an unparallel move, the court gave six options to the government about implementation of the NRO cases.

The options handed over to the Attorney General read as: (1): to initiate the contempt of court proceedings against the Chief Executive and the Secretary Law for not implementing the NRO verdict, (2): to declare the chief executive ineligible from the membership of the Parliament, (3): the court may form a commission to get the verdict implemented, (4): the people themselves decide on the issue and the court exhibit patience (5): contempt proceedings against Chairman Nab may be initiated, (6): the action may be taken against President for violating the Constitution.

In its recent orders over the NRO case, the apex court said that the government had failed to implement over the rulings. It observed that the executive was not showing interests in implementation of the court’s verdicts.

The ruling stated, “The court has taken oath to defend the Constitution. The prime minister respected the party over the Constitution”. According to the Article 189 and 190 of the Constitution all institutions are bound to assist the Supreme Court.

It is worth to highlight that the five-judge bench, on the last day of hearing, had observed that it was giving a final opportunity to authorities to take action against those who violated its verdict.
