Imran Khan, the chief of Pakistan Tehreek-e-Insaf (PTI) has moved the Supreme Court to hold on the by-polls scheduled to be held on February 25.

On Friday, he submitted a civil miscellaneous appeal to his previous petition seeking removal of fake votes from the voter lists prior to the by-elections. The PTI’s chief filed the appeal through Advocate Hamid Khan, saying that the Election Commission of Pakistan (ECP) was holding by-polls without fixing errors in the existing electoral rolls.

The counsel while speaking to the media said that a follow-up petition was filed to hold back the by-elections based on the current voter lists. He was of the opinion that the ECP announced holding by-polls on the scheduled date, despite the apex court ordered to correct the electoral rolls first.

The election commission earlier firmly stated that the deadline given by the apex court to sluice the voter lists of bogus entries by February 23, was humanly impossible and had sought assistance from political parties for extension of the time limit.

While hearing the previous petition filed by the PTI chief, the apex court had said that by-polls could not be held based on the existing voting lists. At the same time, it asked the ECP to recompile them at the earliest.

Chief Justice Iftikhar Muhammad Chaudhry during the hearing had observed that the current electoral lists had over 30 million bogus entries which could not be confirmed.

He observed, “The democratic system is totally based on transparent and free elections, which are not possible without a new and flawless voters’ list.”  He also issued directives the ECP and NADRA (National Database Regulatory Authority) to prepare news lists by February 23.

The CJ also informed that Pakistan Peoples Party’s chairperson Benazir Bhutto, back in 2007, had filed a petition for preparation of new voter lists.

The four-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Pervaiz, Justice Khilji Arif Hussain and Justice Sarmad Jalal Usmani had been hearing the petition filed by Imran Khan.
