Prime Minister will not direct the President to pardon him, if convicted: says Aitzaz Ahsan

Aitzaz Ahsan, the lawyer of Prime Minister Yusuf Raza Gilani stated that the Prime Minister will not direct the President Asif Ali Zardari to pardon him, if he Supreme Court of Pakistan declare him convicted of the court of contempt.

He also said that those are eager to see the Prime Minister being ‘sacrificed’ for the sake of ruling government will soon be disappointed. Ahsan was confident that the tough times will end and the Prime Minister will get pass from the fury of Supreme Court
and he will not need the presidential pardon.

While talking to the Express News host Kamran Shahid, Barrister Aitzaz said that the, “prime minister will not advise the president to pardon him, if convicted.”

While talking in the show, Aitzaz explained the whole process through which the Prime Minister could be asked to surrender his seat in the National Assembly and consequently his position as the PM of Pakistan.

“The entire process could take months,” Aitzaz added.

He further revealed that not all contempt of court convicts result in disqualifications.

Once the verdict comes, the case will be put before the Speaker of the National Assembly, where the speaker will have 30 days from the time the resolution is moved to decide whether Gilani can be disqualified due to the verdict,” Aitzaz said.

He also said that even if the speaker of National Assembly disqualifies Gilani as the PM, the matter will then be handed over to Election Commission, which will decide in 90 days whether his decision disqualifies Gilani or not. Moreover, after that, the
Prime Minister has the opportunity to challenge Election Commission’s decision.

On the other hand, Aitzaz was confident that he will be able to convince the seven-bench commission of Supreme Court that Gilani had not committed the contempt of court.

“The case was closed on merit,” said Ahsan.

“To get money out of Swiss accounts, the government would need to file a civil suit in Switzerland.” Nevertheless, he added that, the time bar for filing this case has passed.”
