Illegal detentions will not be allowed; Supreme Court to intelligence agencies

The Supreme Court on Monday expressed displeasures over the role of intelligence agencies in the missing persons’ case, warning them against illegal detention of people.

Inspector General (IG) Police Islamabad Bani Amin submitted a report before the apex court about 16-year-old Umer Muhammad Wali Khan, who went missing on March 10 and found after six days.

IG Islamabad said the boy returned home on Saturday after the police sought assistance from intelligence agencies. He, however, said they were not sure who picked up and later released the boy.

During the course of hearing, Chief Justice Iftikhar Muhammad Chaudhry said it should be investigated that who kidnapped the boy, saying the number of missing persons is increasing. He remarked that some should be dealt according to law of the land, if he/she has committed any crime.

The boy was produced before the apex court along with his father. During the hearing, the boy said he was investigated by unidentified people regarding numerous topics. He told the apex court that he had no idea who the abductors were

The father of Umer informed the bench that some unknown men had abducted his son in front of him.  He observed “We came to Pakistan one-and-a-half years ago and now mulling to go back”.

Iftikhar Muhammad Chaudhry said it is illegal to arrest people without any case and there was no reason to hold Umer for six days. Later, he instructed the Attorney General of Pakistan, Maulvi Anwarul Haq, to convey this to all concerned agencies and sought report into this matter within fifteen days.

Advocate Tariq Asad on March 16, 2012 submitted a civil miscellaneous application during missing persons’ case, complaining that on March 10, one Umer Muhammad Wali Khan, who was voluntarily providing food to the relatives of the detainees, was picked up and his location was then unfamiliar.

Upon which, the court issued notice to the AG as well as IG Islamabad to take all necessary steps to recover Umer Muhammad Wali Khan and produce him before the court on March 19.

The apex court asked the Islamabad police to submit an investigative report, pertaining to the boy, within the next two weeks.
