Aitzaz Ahsan says he was aware of the decision

Senator Aitzaz Ahsan, the council for Prime Minister Syed Yousaf Raza Gilani in the contempt of court case on Wednesday clarified that they would not file appeal against disqualification of the premier.

While talking to media, the renowned lawyer and former president of the Supreme Court Bar Association (SCBA) said that he was aware of the apex court judgment regarding Gilani’s disqualification.

He observed, “We will accept and implement the apex court judgment but we have reservation on it. Appeal could not be field in the case now”. Elaborating the reservations, he said that three-member bench changed the judgment of seven-judge bench of the apex court.

In his view, the decision to not file an appeal against the order in the contempt of court case was not a mistake. He said the court had done what it wanted to do.

The lawyer informed that he prepared the documents, consisting of 250 pages and 146 questions, but the PPP had decided not to appeal against the verdict, fearing that Gilani would be disqualified from his post.

He noted, “The court however decided what the PPP feared. The seven-member bench did not disqualify him, but the three-member bench did. It would have made no difference”.

Aitzaz Ahsan continued that the three-judge bench, in its April 26 ruling, had announced that a question is likely to arise on Gilani’s disqualification but it didn’t do it.

He further remarked, “The bench on Tuesday said that I should have filed an appeal against the verdict. They also said that they cannot amend their decision, I say you have amended it – you did what the seven-member bench did not do.”

The Pakistan Peoples’ Party (PPP) Senator asserted that he had prayed several times before the court that it should not take a decision against individuals, as it leaves no room for an appeal.

He anticipated that a new order to write a letter to the Swiss authorities will be issued to whosoever will take the Prime Minister office.

He stated, “My opinion has never changed. I have said this time and again that there is no harm in writing a letter to the Swiss authorities, but not writing is also not a crime”. A letter cannot be written until President Asif Ali Zardari is in power, he added.
