Seven-member bench cannot overrule verdict of full-court: Faroo H Naek

Federal Law Minister Farooq H Naek on Thursday said a seven-member bench of the apex court couldn’t override the verdict delivered by a full-court bench.

While speaking to the media after a court hearing on the federal government’s review petition against the court’s July 12 verdict, the minister made it clear that the government doesn’t want confrontation among institutions.

Farooq H Naek applauded the court for hearing him properly and sufficiently. He observed, “We will have to sit together to give positive musing to the national interest. The government will hold consultations over Prime Minister’s appearance before the court on August 27”.

While answering a question, the law minister said that all powers were vested in Chairman National Accountability Bureau (NAB) in accordance with the NAB Ordinance.

Commenting about the future line of action in the NRO implementation case, he said that his appearance before the court signals that the government takes the issue seriously.

The minister said the government will follow the constitution and law in the NRO implementation case, adding that the Pakistan Peoples’ Party (PPP) will hold discussion within the party and at the coalition level to find out solution of the matter.

Attorney General Irfan Qadir in the course of hearing informed the court that he had held meetings with Prime Minister Raja Pervez Ashraf and Law Minister Farooq H Naek.

Requesting the court to grant the government more time in order to carry out consultations on the matter, the attorney general said that the government had all intentions of implementing the court’s directives.

He also submitted before the court that government wants to resolve the issue amicably, adding that the presence of Law Minister Farooq H Naek in the court room is proof of government’s seriousness.

It should be mentioned here that the apex court, in its July 12 order directed Prime Minister Raja Pervez Ashraf to write a letter to Swiss authorities to reopen graft cases against President Asif Ali Zardari without seeking any advice.

In previous hearing on Wednesday, Justice Asif Saeed Khan Khosa observed that the prime minister was not to apply his independent mind but to give direction for implementation of the court’s order in the NRO case.
