Chief Justice Iftikhar Muhammad Chaudhry terms rule of law only solution to problems

Chief Justice Iftikhar Muhammad Chaudhry on Monday said the rule of law is the only solution to all social and economic problems, adding that better society couldn’t be developed without giving equal rights to people.

While addressing a ceremony of new judicial year, the chief justice underscored the need for a better understanding of issues being faced by the system in way of speedy justice.

Commenting about role of executive in implementing laws of the land, Chief Justice Chaudhry said that all the institutions including legislature and executive should have rendered their support and cooperation in the execution of judicial process.

He observed, “The principle of trichotomy of powers embedded in the provisions of the Constitution aims at creating an atmosphere of harmony and collaboration among all the State institutions in order to achieve the goal of fair dispensation of justice”.

He was of the opinion that the judicial activism on the part of the Supreme Court has not only improved the judiciary but also increased public trust and confidence over the institutions.

He stated, “Corruption is a great menace, which is required to be dealt with iron hands. A Cell for Eradication of Corruption from Judiciary has been established under the supervision of Chief Justices of High Courts for disciplinary action against corrupt and incompetent judicial officers and court officials”.

The chief justice underscored the role of judges in establishing political stability in the country, saying that judiciary is required to preserve, protect and defend the rule of law.

He further said that the duty of protecting and defending the Constitution was cast on all government and elective office holders in the national interests of the country.

The success of the Judicial Policy might be gauged from the fact that by the grace of Allah until 31 December, 2010, the figure of cases lying pending in the superior as well as district courts was successfully reduced from 1.75 million to about 1.35 million cases, despite institution of more than 3.2 million new cases.

He remarked, “Doing justice is something more than doing justice. It is doing justice with mercy and compassion. It is close to the fear of Allah Almighty”.
