Supreme Court reaches a dead-end after disqualifying Gilani: Aitzaz Ahsan

Pakistan Peoples’ Party (PPP) Senator Aitzaz Ahsan has said that the Supreme Court had reached a dead end after disqualifying former premier Yousaf Raza Gilani in the National Reconciliation Ordinance (NRO) implementation case.

While speaking to the media, he said that the apex court now wanted an acceptable solution of writing a letter to Swiss authorities. It is vital to mention here that he was Gilani’s counsel in the NRO case.

When he was asked a query about the draft of the letter, he said that he had not seen it but still had some reservations on it. If the letter is written on the dictation of the Supreme Court then there will be many complications, he added.

He, however, said that he was not sure whether the letter will be written or not, clarifying that he was not taken onboard in this regard.

He was of the view that the letter in view of paragraphs 177 and 178 the Supreme Court’s order in the NRO case would against the president. Even though, the apex court had not discussed the immunity in both paragraphs, he maintained.

“The concessions being extended to incumbent Prime Minister Raja Pervez Ashraf were commendable but his predecessor Gilani was not extended any such concessions by the apex court”, he added.

He opined, “The SC had not treated Gilani as it is treating now Raja Pervaiz Ashraf over the same situation.”

The renowned jurist, who was also former president of the Supreme Court Bar Association (SCBA), said that the apex court was now left with only option of sending another premier home if letter was not written to Swiss authorities.

In his view, it was looking difficult for the court to do so in the present scenario.

Rejecting the impression that the presidency and the Supreme Court had an understanding on ousting Gilani, he made it clear that there was no such understanding between them.

“The disqualification of the second prime minister for not writing letter will disturb the circumstances severely as compare to the previous,” Ahsan feared.

In his view, the government should convince the court that the President of Pakistan should not present himself before a foreign magistrate.
