Only Gov’t can initiate treason case against Musharraf

Ahmad Raza Kasuri, defence lawyer of former president Pervez Musharraf’s lawyer, says that it is the exclusive domain of the Federal Government to initiate a high treason case under article 6 of the constitution.

He told Radio Pakistan that no institution can direct the federal government in this regard.
He said statements of Secretaries, Law and Interior in the Supreme Court endorsed his stance. They said that their mandate is to hold free, fair and transparent elections.

 

He said after their statements, the position has now become clear that the Federal government has no intention to lodge a case against Pervez Musharraf under article 6.
Kasuri said that under the  constitution the mandate of the caretaker government is to hold free and fair general elections.
He said under the High Treason Punishment Act 1973, only the federal government can call for high treason case.

 

Kasuri’s statement came hours after defence lawyers told the Supreme Court that Musharraf has been barred from leaving the country without hearing them.

 

Ibrahim Satti advocate told the court during high treason hearing that Musharraf’s mother is seriously sick in Dubai and he could proceed there.

 

Former Law Minister Khalid Ranjha said that under the constitution the mandate of the caretaker government is to hold the general elections.
He said, therefore, the caretaker government has denied taking up the case and said that if the previous governments could not do this how they can do it in just few days of their tenure.
Prominent lawyer Qazi Anwar said that the caretaker government has tried to avoid the case due to certain implications.
He said the new elected government must take up the case.
