SC cancels caretaker gov’t postings/transfers

The Supreme Court of Pakistan has nullified all appointments and transfers made during caretaker government.

A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry announced the verdict in Islamabad Wednesday.

The apex court ordered setting up of a three-member commission for new appointments in corporations and autonomous bodies.

The court observed that the caretaker government overstepped its mandate as it did not have the authority to make postings and transfers. It said the job of the caretaker government is to hold free and transparent elections and run day to day affairs.

The court remarked the caretaker government can transfer only those officers who can influence the electoral process.

The apex court observed the new government can review postings and transfers within fifteen days.

The PML-N MNA Khwaja Asif had challenged the postings the caretakers had ordered just few days before the transition to the new government.

He had prayed to the apex court to declare the acts of the care-taker government in effecting the transfers/postings/shuffling null and void, void ab initio and of no legal effect being in contravention of Constitution, constitutional conventions and law.

The petition had also requested the court to direct the Federation/care-taker government to refrain from effecting any further appointments/transfers/shuffling during their remaining tenure.
