The Chief Justice can do no wrong!

Every newspaper article along with social media websites are filled with discussion about the Chief Justice’s son, Arsalan Ifthikar, and his involvement in a receiving Rs.300-400 million to settle, in favour of the payer, a case going on in the Supreme Court at the moment.

There have been many accusations levelled against both parties, Arsalan Ifthikar and Malik Riaz, who is the chief of the Bahria Town housing societies in Pakistan, but up until now, none have been proved.

While Malik Riaz claims to have concrete evidence against the CJ’s son in this case, Arsalan Ifthikar denies all allegations levelled on him. Arsalan Ifthikar might have received kickbacks and he might not have, but what seems to be surprising is the fact that analysts and politicians are either targeting the Chief Justice in a good or bad way, but for what is the question.

With the due process of law being carried out, the Chief Justice separating himself from the case, something appealed for by the Attorney General Irfan Qadir as the case began, is definitely a good step but there are still a number of reservations people have about this whole issue.

As the Prime Minister was called to the court for contempt, it was demanded of him from day one that he resigns and faces the courts like a common citizen. That coming from people like Nawaz Sharif that notoriously attacked the Supreme Court when facing the same situation.

But when it comes to the case of Arsalan Ifthikar, separating himself from the case seems to be more than enough in order for justice to be dealt. Is that really the case? Does anyone really believe that if Ifthikar Muhammad Chaudhry is still the Chief Justice that the decision coming out will be a credible one?

This is not saying that the Chief Justice is not a competent person, but when you are in inferior judge, going against the child of your chief can always be a problem and when it comes to the current judges, they have always shown preference in letting the CJ guide them.

For example, when the decision of who to make Chief Justice of the Lahore High Court was to be decided following Khawaja Sharif’s transition, Justice Mian Saqib Nisar chose to follow the chief in not being appointed the CJ of the High Court in accordance to directives of President Asif Ali Zardari.

There have always been cases against Arsalan Ifthikar, from his acceptance into a medical college being suspicious along with failing in the Central Superior Services examination twice but still being accepted into public office and now, receiving huge amounts of money in order to influence a case.

What seems to be the most surprising part is that the Chief Justice has openly explained how he has no knowledge of what his son does for business despite living in the same house and suddenly going from living a middle class lifestyle to driving BMW’s and living in five star hotels abroad.

When you are in such a position, knowing what your children are doing should be top priority since taking advantage of a father’s designation is the easiest thing anyone could do. Having worked hard all your life to maintain a good reputation and allowing someone that close to you dismantle it in an instant just seems to be something lacking on your own part.

As Malik Riaz’s lawyer, Zahid Bukhari, stated recently that his client will be returning to Pakistan in the upcoming days and present hard evidence along with make surprising revelations to the media, it will be exciting to see how this whole scenario plays out.
